These Terms and Conditions govern access to and use of the website, as well as the booking of stays and services at Nômade Temple Ibiza, operated by NOMARD IBIZA, S.L. (tax ID B10759876, Camí De Sa Torre Nº 74 - Sant Joan De Labritja - 07810, Illes Balears).
Access to the website grants the status of user and implies acceptance of these Terms and Conditions in their current version. The booking of stays also requires express acceptance of these Terms and Conditions during the booking process.
The user undertakes to use the website lawfully, in good faith and in accordance with public order, and to provide accurate information in the forms. The use of automation software is prohibited, as is any action that may damage, overload or impair the website or prevent its normal use.
The website is intended for users over the age of 18.
Bookings are made through the booking engine on the website or through the contact channels provided. Before confirming a booking, the user will have access to the pre-contractual information required by consumer regulations: the identity of the business operator, the characteristics of the service, the total price including taxes, payment conditions and the cancellation and modification policy applicable to the selected rate.
The booking will be confirmed once the confirmation email has been sent to the email address provided by the user, who must check that all details are correct.
Prices are stated in euros and include the applicable taxes. Where relevant, any tourist taxes or charges payable at the destination will be indicated separately. Accepted payment methods are shown during the booking process. The establishment may request a guarantee or prepayment depending on the selected rate.
Cancellation and modification conditions depend on the rate booked and are provided before the booking is confirmed and in the confirmation email.
Free cancellation periods vary depending on the type of room booked and the date. Late cancellations and no-shows will be charged at 100%.
Right of withdrawal: in accordance with Article 103.l) of Royal Legislative Decree 1/2007 (TRLGDCU), the right of withdrawal does not apply to accommodation services booked for a specific date or period of performance, without prejudice to the cancellation conditions of the rate booked.
During the stay, guests must comply with the establishment’s internal rules, including opening hours, noise policy, access to facilities such as the spa, restaurants and club, minors policy and pets policy, which will be available for consultation through the channels enabled by the establishment.
The establishment may refuse continued stay to anyone who fails to comply with these rules or with applicable law.
The owning entities do not guarantee uninterrupted availability of the website and shall not be liable for damages arising from causes beyond their reasonable control. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability arising from wilful misconduct or gross negligence, nor does it affect the mandatory rights granted to consumers and users under applicable consumer protection regulations.
The content of the website is protected by intellectual and industrial property rights. Its use for commercial purposes is prohibited without express authorisation, although personal and private use is permitted.
The processing of personal data is governed by the Privacy Policy, available on the website.
In accordance with Regulation (EU) 524/2013, users are informed of the existence of alternative consumer dispute resolution mechanisms.
These Terms and Conditions are governed by Spanish law. For any dispute, the parties submit to the Courts and Tribunals of the registered address of the owner of the corresponding establishment.
However, if the user is a consumer, this submission shall not deprive them of the protection granted by any mandatory applicable rules, and they may bring proceedings before the courts of their own place of residence.
